Courts, studios, stadiums and acreage

Four kinds of property live under this name: homes built around a pool, a court, a fairway, a theater or a studio; homes close to Nashville's stadiums and stages; property where privacy matters most; and land used for hunting, fishing and events. Each one comes with its own rules.

Built in: pools, courts, golf, theaters and studios

  • Pools: Tennessee's pool alarm law covers home pools, hot tubs and nonportable spas that hold water deeper than 36 inches [1]. For a pool installed after January 1, 2011, the owner must install and keep up an alarm before the pool is used [2], and local pool permits depend on it [3]. Columbia and Rutherford County apply the 2024 International Swimming Pool and Spa Code, including a barrier at least 48 inches high [4][5]. In Franklin, pools and spas that can hold 24 inches of water or more need a permit, and no water goes in until the permanent barrier is up [6].
  • Home studios: zoning decides what a home studio can do. Franklin, for example, limits a home occupation to one employee who lives elsewhere and bars noise that can be heard off the property [7]. Check the city or county rules and the HOA covenants, which can be stricter.
  • Courts and lights: Franklin's lighting rules call for fixtures aimed so the light source isn't visible from a neighboring home [8]. Ask the city how a backyard court is reviewed.
  • Golf: not every home in a golf community faces the course, and some courses are laid out with no homes along them. Check whether the lot fronts the course, whether club membership is required or separate from the HOA, and any errant-ball easements.

Privacy and a quiet closing

Records at a Tennessee register of deeds are presumed open to the public [24]. The state's property assessment site can be searched by owner name [25]. Tennessee deeds carry a sworn statement of the price or value [26]. Tennessee's address confidentiality program can't be used on recorded property documents [27]. Whether to hold title through a trust or an LLC is a decision for a Tennessee attorney, before you sign. Using a drone to capture images of a person or private property with intent to conduct surveillance is a misdemeanor in Tennessee [28]. A licensed broker's listing photos are allowed when no person is identifiable [29]. A private sale can run on pre-qualified showings, a nondisclosure agreement and limited photos, where the rules allow.

Recreation land: hunting, fishing and events

  • Licenses: Tennessee-resident farmland owners, their spouses and children can hunt and fish their own farmland without a license if they meet TWRA's conditions and sign the exemption statement [30]. Nonresident owners don't qualify [31].
  • Liability: Tennessee's recreational use statute limits a landowner's duty to people using land for hunting, fishing, camping and off-road riding. The exceptions include gross negligence and willful conduct [32][33]. Ask an attorney about paid access.
  • Agritourism: liability protection for agritourism requires warning signs at the entrance and at each activity site, in black letters at least one inch tall [34].
  • Camps: organized camps need a state health permit. A private hunting or fishing camp used only by its owner is excluded [35].
  • Short-term rentals (as of October 2026): Metro Nashville requires a short-term rental permit before listing. New non-owner-occupied permits aren't issued in its main residential zones [36].

Do I need a pool alarm in Tennessee?

Yes, for most home pools, hot tubs and nonportable spas deeper than 36 inches installed after January 1, 2011 [1][2].

Can clients come to a home studio?

It depends on local zoning. Franklin, for example, allows one nonresident employee and bars noise heard off the property [7].

Will my name and price be public?

Generally yes: deeds are public, assessor records are searchable by owner name, and deeds carry a sworn price or value [24][25][26].

Can someone fly a drone over my property to film it?

Capturing images of a person or private property with intent to conduct surveillance is a misdemeanor, with exceptions such as owner consent [28].

Am I liable if friends hunt or ride on my land?

The recreational use statute limits a landowner's duty, with exceptions that include gross negligence and willful conduct. Ask an attorney about paid access [32][33].
